Smally v. Nationwide
The Focal Point teamed up with Commins & Knudsen, P.C. to represent plaintiff Marin Mortgage Bankers (Marin) in a case against Nationwide Insurance regarding a Bad Faith claim on a home insurance policy. Our client’s argument involved a failure by Nationwide to upgrade a policy to the full extended replacement cost policy promised, failure to properly and promptly notify lender Marin of policy non-payment by the homeowner, and Bad Faith in placing the policy payments out of Marin’s reach.
The Focal Point’s Role
The Focal Point worked closely with Kit Knudsen and David Commins to prepare for opening and closing statements and visually explain key themes about the case, including contrasting the Bad Faith actions of Nationwide with what should have happened with the claim.
The jury unreservedly agreed with our clients and awarded $691K in compensatory damages and $1.2M in punitive damages.
